Terms + Conditions 1/7


This document gives you information about us and the legal terms and conditions by which we sell any of our antique, contemporary or bespoke pieces to you.

Please read these terms carefully and make sure that you understand them before ordering. By ordering any of our pieces from us, you agree to be bound by these terms. We amend these terms from time to time - these terms were most recently updated on 26th November 2024.

PRICES

Prices are set out on our website and where applicable an item is marked as plus VAT. We reserve the right to alter our prices at any time.

From time to time it may be necessary to either increase or decrease our prices, including any alterations to the rate of VAT. Any price changes will be confirmed to you at the time of ordering.

No VAT will be normally be charged on goods shipped outside the UK on the provision that the we receive the necessary export documentation from the customer within three months from the date of the invoice. If the necessary documentation is not received, VAT will be invoiced to the customer and will be immediately payable by the customer.

Matthew Cox delivers worldwide.For delivery outside the UK, you will be responsible for obtaining all necessary licences and complying with all applicable legislation and regulations governing the export of goods from the UK and the importation into the country of destination. You will also be responsible for the payment of any applicable import duties, taxes and tariffs and/or other charges of a similar nature.

 

PAYMENT

Full payment should be made in GBP only unless otherwise arranged.

Preferred payment is by online payment link or bank transfer. Your invoice will include all relevant bank information.

We also accept MasterCard, Visa, American Express and all major credit cards. We reserve the right to refuse payment by credit card.

LEAD TIMES

Lead times for made-to-measure and bespoke orders can vary from 8 – 16 weeks. Please confirm your proposed installation date with us at the point of ordering.

Where an item is made to order, we specify a lead time that we do everything we can to adhere to. Occasionally things happen that are outside of our control and may cause a delay to your order. We will do our best to keep these to a minimum and will keep you updated on the progress of your order until completion.

DELIVERY

Your quoted price does not include delivery or shipping unless specifically stated.

You're welcome to make arrangements for collection of your pieces from our workshops directly on date that we agree between us. Please note that can't accept responsibility for orders damaged in transit once they have left our premises.

We're happy to provide quotes for UK carriage on confirmation of the delivery address. Your piece will be delivered in our own van unless otherwise arranged.

We are also able to provide an export packing and shipping service including insurance from our preferred shipper - please ask for a quotation. Alternatively, you're welcome to handle your own shipping, which means your shipper would take responsibility for collecting your order from our workshops, all export packaging, arranging customs documentation and organising the freight. 

UNCOLLECTED ITEMS

Items uncollected within 6 months without arranged storage or a future delivery/collection date, will be resold and no refund will be given.

SHIPPING INSURANCE

Please note any discrepancies such as shortage, non-delivery, leakage and damage on the delivery receipt, including that which may only be superficial damage to the outer packaging, such as denting, scuffing, staining etc.

The time limits for providing notice of claim vary between the different Conditions of carriage or Bailment but timescales are generally very short and not providing a timely notification is likely to invalidate any potential claims.

In the event of damage, please provide clear, good-quality photographs showing any issues and please submit any estimates to the address before completing any repair so we may seek approval from our insurance company. Please ensure you retain any correspondence relating to the loss or damage.

PURCHASE OF ITEMS ONLINE

While we work hard to portray items accurately, variations may occur due to the calibration and settings of individual screens. 

You are responsible for taking note of the sizes of items supplied on our website, and for supplying the correct measurements for items being ordered. We cannot accept the return of items that do not fit through doorways, or are incorrectly specified for the space. 

The drawings, samples and sale price provided to you as part of your commission process are confidential and should not be transferred or made available to third parties without prior discussion. 

MATERIALS 

We use high quality natural materials that contain variations in colour, pattern, grain, knots and other character markings. We cannot accept returns or refunds based on natural variations in our materials. If a certain level of uniformity is required, please discuss your requirements with us before confirming your order.

Wood is a natural material that moves in response to changes in ambient moisture levels. We only work with wood that has been dried to the appropriate moisture level for our local climate, and we construct furniture in a way that allows it to best respond to changes in ambient conditions. We can't accept returns based on dimensional or structural issues caused by climatic change once a product has left our workshop.

Sheet metal is a material that changes dimensionally in response to fluctuations in ambient temperature. We cannot accept the return of sheet metal products based on issues created by a change in temperature once they have left our workshop.

FINISHES

The finishes and patinations at Matthew Cox are applied by hand with care to each individual piece, so hand finishes willl vary slightly.

The colours of our finishing products remain consistent, but will appear differently according to the colour of the timber boards on which they're applied. Please view the examples of finished pieces shown on our website before confirming your order. If you require a higher level of uniformity please discuss your requirements with us before confirming your order.

Fuming is a natural process that can produce a variety of tones and hues across different oak boards. By using oak from a single log we ensure the best consistency of colour, but variations should still be expected. Please view the examples of finished fumed pieces shown on our website before confirming your order. If you require a higher level of uniformity please discuss your requirements with us before confirming your order.

All of our brass alloy comes from recycled sources and contains varying levels of chemical elements. When patinated this produces a variety of tones and hues across different elements and diffrent items. Please view the examples of finished pieces shown on our website before confirming your order. If you require a higher level of uniformity please discuss your requirements with us before confirming your order.

The hand-patinated colour of our sheet copper and zinc will vary from section to section, and within each section. Please view the examples of finished pieces shown on our website before confirming your order. If you require a higher level of uniformity please discuss your requirements with us before confirming your order.

All of our finishes are designed to evolve and develop over time, so none are impervious to marking. Our care guides explain what to expect and how best to care for your piece. 

WARRANTY AND LIABILITY

By looking after your item in accordance with our care guides it should give you many years of use.

We warrant that our items comply with their general description and the narrative on our quotations and invoices. To our knowledge, your order will be free from material defect at the time of delivery. 

Our warranty does not apply to:

Any defect in the product arising from: fair wear and tear, willful damage, abnormal storage or working conditions, accident, negligence by you or by any third party;

Failure to use the item for its intended purpose, or if you use it other than in accordance with any care guides that we provide.

Any alteration, repair, or modification carried out by you or by a third party; or any specification provided by you. We only supply goods for domestic and private use by consumers. We make no warranty or representation that the goods are fit for commercial, business or industrial use of any kind (including resale - unless otherwise agreed). We will not be liable to you for any loss of profit, loss of business, interruption to business, or for any loss of business opportunity.

LICENCES, CONSENTS & PERMISSIONS

You agree that you have obtained all necessary licences, consents, and permissions required in order to commission us to supply bespoke products to you. 

 

CANCELLATION

Antique pieces

You are entitled to cancel your purchase if you wish providing you act within seven working days of placing your order with us.

If your order has already been dispatched, or you placed your order more than seven days ago, please follow our returns information.

Made to measure and bespoke pieces

You are entitled to cancel your purchase if you wish providing you act within 7 working days of placing your order with us.

If you wish to cancel an order please email camilla@matthewcox.com or call us on +44 (0) 1780 481092.

Our made to measure and bespoke pieces of furniture and lighting items are made-to-order and so in the event that having placed an order you wish to cancel it, if this is outside the seven-day period listed above, it will be at our discretion whether we are able to cancel the order. This applies to cancellation of orders prior to delivery. If your order has already been delivered, we do not offer a cancellation service.

RETURNS

Antique pieces

If you are unhappy with a product for any reason, just send it back to us within 28 days (with the original packaging) and we will exchange, replace, or credit the cost against a future purchase.

Please contact us quoting your invoice number, no later than 28 days from the date you receive your purchase, stating that you will return the item including the original packaging. Provided the item is in saleable condition, we will exchange or replace the item(s) or credit the amount against a future purchase, along with any standard delivery charges*. 

(*Where expedited or bespoke shipping was requested we regret that we are unable to offer a refund on this cost.)

This does not affect cancellations or your statutory rights.

Contemporary and bespoke orders

Matthew Cox contemporary and bespoke orders can only be returned or exchanged if faulty. 

You will be responsible for the cost of returning the goods to us, and will remain responsible for any and all returned goods until they reach our warehouse. We strongly advise that a proof of postage certificate should be obtained when returning any part of you order. Certificates are available free of charge from the post office.

Returns and exchanges will be processed as soon as possible after arrival.
